Privacy Policy: ThinkQuest Competition

This Privacy Policy applies to your use of www.thinkquest.org (the "Site"), the online platform for teams competing in the ThinkQuest Competition (the "Competition"). The Site is hosted by the Oracle Education Foundation (the "Foundation").

Herein, "you" or "your" refers to you as a visitor to or user of the Site. "We", "our", or "us" refers to the Foundation.

This Privacy Policy explains what personal information the Site collects, how we use and protect this information, and your choices regarding your personal information. By using the Site, you accept and agree to the practices described in this Privacy Policy.

Children's Privacy Seal

The Foundation has been awarded TRUSTe's Children's Privacy Seal. This Privacy Seal signifies that the Foundation’s privacy policy and practices comply with TRUSTe's program requirements including transparency, accountability and choice regarding the collection and use of your personal information. Personally Identifiable Information

"Personally Identifiable Information" is information that can be used to identify a particular person. Unless you or a Competition coach provides it to us voluntarily, the Foundation does not collect Personally Identifiable Information about you. You must ensure the accuracy of all information you provide via the Site. You must have the authority to provide such information through the Site and you agree that we may use information you submit to verify such authority.

Personally Identifiable Information We Collect

Personal information collected from a coach who registers for the Competition includes:

  1. his/her first and last name and work email, and the name, mailing address, website and phone number of his/her school or organization (each, an "Organization");
  2. the first and last name, work email and title of the person with legal signing authority for the Organization; and
  3. the first name, state, and country of residence of each student on his/her team.

Personal Identifiable Information also is collected through the Site when users register for the Competition, ThinkQuest Live or a local celebration event, register to use a non-public area of the Site or to receive additional information from the Site, order certificates of achievement, complete surveys and other purposes related to Competition participation. Personally Identifiable Information collected in these circumstances may include:

  1. first and last name;
  2. mailing address;
  3. telephone number;
  4. age/date of birth;
  5. gender;
  6. personal interests (hobbies and sports); and
  7. digital photographs.

Personally Identifiable Information is not collected through the Site's Library (the "Library") but Competition entries housed in the Library may contain Personally Identifiable Information about the team that created them (e.g., the first and last name of the coach, the coach's Organization name and country, and the first name of each student on the team). Any other Personally Identifiable Information will be deleted from the Library.

The Foundation does not condition anyone’s participation or access to an activity on him/her providing more Personal Identifiable Information than is reasonably necessary for that activity.

Other Information We Collect

The Site uses a third-party technology service to track usage of the Site by collecting non-personal information about users. The non-personal information collected includes users' browser information, the IP/Internet addresses of the domains from which users access the Site, the URL of the page visited and the date and time of the visit. We use this non-personal information to improve the Site.

"Cookies" are small pieces of data that websites send to web browsers. We use cookies to track user preferences and personal interests and to evaluate how the Site is used. This information helps us to improve the Site's design. We also use cookies to authenticate users, which helps maintain the security of the Site. For this reason, our cookies are tied to personal information.

Some of the Site's Competition entries, including but not limited to those hosted on third party websites, may include third-party tracking technologies, such as web beacons or ad servers. Information collected by these third-party technologies is governed by separate privacy policies.

Use of the Personally Identifiable Information We Collect

The Foundation uses Personally Identifiable Information to provide its educational services and programs, including to send you emails about the Competition and other information that we think may interest you and to recognize Competition participation and achievement. Personally Identifiable Information is used during participation in the Competition and for a reasonable time thereafter as may be required for the Foundation's business purposes. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Disclosure of the Information We Collect

  1. Personally Identifiable Information is disclosed only as described in this Privacy Policy. We do not sell or rent user information to third parties, except as described in 6 below.
  2. Personally Identifiable Information may be made available to authorized Foundation staff in other countries and to approved third parties that support the Competition and our related educational services and programs, such as service providers that require access to the information in order to support the Site. Any information provided is used and processed in accordance with this Privacy Policy. These third parties may not use any Personally Identifiable Information for their own marketing purposes.
  3. We may disclose Personally Identifiable Information to recognize Competition participation and student and teacher achievement.
  4. We may disclose Personally Identifiable Information and other data to comply with applicable legal requirements, including disclosure of information to government, law enforcement or other authorities.
  5. We will, and by agreeing to the Competition Terms of Use and this Privacy Policy you authorize us to, disclose Personally Identifiable Information when we, in our sole discretion, believe that disclosing such information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) the Site, our rights or property, any user or any third party.
  6. In the event of a sale, merger, liquidation, dissolution or transfer of substantially all of the Foundation's assets, Personally Identifiable Information submitted to the Site and/or usage data may be sold, assigned or transferred to the party acquiring the Foundation's assets in order to permit such party to continue to operate the Site. By using the Site, you consent to the sale and transfer of your information as described in this paragraph.

In addition to these disclosures, your Personally Identifiable Information could be accessed if someone unlawfully accesses the Site, despite our security measures which are described below.

Consent to Processing

By using the Site or providing information to us, you understand and consent to the collection, storage, processing, transfer and use of such information, including Personally Identifiable Information, in the United States and other countries and territories exclusively for the purposes set forth in this Privacy Policy. Any consent relating to a right to transfer information referred to in this Privacy Policy shall include your consent to the transfer of the applicable Personally Identifiable Information to a jurisdiction which may have a different level of privacy protection than is available in your own country.

Parental Consent

Parental consent is required before a minor can participate in the Competition and before a coach or other user submits any Personally Identifiable Information about a minor. All submitted information is handled in accordance with this Privacy Policy. A parent has the right to provide consent to the Foundation’s use of his/her child’s Personal Identifiable Information without having to consent to disclosure of that Personally Identifiable Information to third parties in accordance with this Privacy Policy. Information Modification and Opt-Out Choices

You may review, modify, or delete the Personally Identifiable Information that you submit to the Site or opt-out of any consent previously granted regarding Personally Identifiable Information. Parents of children using the Site may instruct the Foundation to modify or delete their children's Personally Identifiable Information or may opt-out of any consent previously granted regarding their children's Personally Identifiable Information collected via the Site. Linking

  1. This Privacy Policy applies only to the Site.
  2. The Site may include links to other sites, including sites on which Competition entries are posted ("Other Sites").
  3. Other Sites are not operated or controlled by us and we are not responsible for any aspect of Other Sites. We urge you to read and understand the privacy practices of Other Sites before providing any personal information to them.

Data Security

We have in place adequate technical and physical security measures that are intended to prevent unauthorized access to Personally Identifiable Information. We also use standard security protocols and mechanisms, such as encryption, to exchange or transmit sensitive data.

Modifications to this Privacy Policy

We reserve the right to revise and re-post this Privacy Policy on the Site. We will update the "LAST UPDATED" date below when this Privacy Policy is modified in any way. If we make material changes to how we collect, use or disclose Personal Identifiable Information collected from a child under age 13, we will notify coaches by email to obtain verifiable parental consent for these changes.

We also will provide notice of any material changes to this Privacy Policy by posting a "New Privacy Policy" link on the Site's home page.

No Rights of Third Parties

This Privacy Policy does not create rights enforceable by third parties.

Conflicts

In the event of any conflict between or among this Privacy Policy, the Competition Terms of Use and the Competition Rules, they have the following order of priority: Competition Terms of Use, Competition Rules and Competition Privacy Policy.
